Am I right? There's no obscure law that says eyases of banded parents have to be banded if their whereabouts is known and reachable, and the owner of the property has to give access for the banding, is there? I think I'm just hoping against hope.

I think I'm just hoping against hope. There is no requirement that they be banded in the nest. Most inaccessible scrapes go with a band if/when they come to ground after fledging. And if they never come to ground, oh well. That said, if there are eyases DEC might be more pro-active with the owners rather than the current wait & see policy.
